Terms of service
## Scope
The general terms and conditions (GTC) apply to all orders that customers place via the Confiserie Tea-Room Brändli Aarau AG online shop. They are an integral part of every sale between Confiserie Tea-Room Brändli Aarau AG and the customer of the online shop.
Certain products may contain alcohol. The customer confirms by sending the order that both he and the recipient (if different from the customer) are of legal age at the time of the order.
## Conclusion of contract
As soon as the customer receives an order confirmation after receipt of the order, the purchase contract is concluded. Confiserie Tea Room Brändli Aarau AG reserves the right to request advance payment for larger invoice amounts and for customers with a billing address abroad.
## Order changes
Orders are binding. Once the order has been placed, the customer can no longer make any changes to the order.
## Prices
The prices include VAT (2.5%).
Prices are subject to change.
## Delivery conditions
The customer bears the costs for shipping and packaging. The costs for shipping and packaging are shown on the invoice or delivery note.
Shipping is usually carried out by "Die Post". For shipping times, please refer to www.post.ch.
Confiserie Tea-Room Brändli Aarau AG is not liable for delivery delays that are not its fault, e.g. due to force majeure or incorrect delivery address information provided by the customer. The same applies to delivery delays that are attributable to the parcel courier or customs. This does not give the customer the right to withdraw from the purchase contract or to claim damages.
If not all of the goods ordered are in stock, Confiserie Tea-Room Brändli Aarau AG reserves the right to make partial deliveries. This does not incur any additional costs for the customer.
If the delivery is not accepted by the recipient or if it cannot be delivered (incorrect address information, the recipient cannot be identified by the carrier at the specified address), Confiserie Tea-Room Brändli Aarau AG is entitled to charge additional costs for a new delivery attempt.
Customs fees may be incurred for international shipments. These are to be borne by the customer and, if necessary, paid upon receipt.
## Retention of title
The goods remain the property of Confiserie Tea-Room Brändli Aarau AG until they have been paid in full and dispatched.
## Checking the delivery / complaints
The customer must check the delivery for defects immediately after delivery. Any complaints regarding quality and completeness must be reported to Confiserie Tea-Room Brändli Aarau AG immediately, but no later than within 24 hours of delivery, otherwise the delivery is deemed to have been accepted.
## Return / exchange
Return or exchange of products delivered to the customer complete and undamaged is excluded.
## Liability
Confiserie Tea-Room Brändli Aarau AG excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by assistants and substitutes. The seller is not liable for problems with customs clearance.
## Applicable law and place of jurisdiction
The contracts are exclusively governed by Swiss law. The place of jurisdiction is Aarau.
## Final provisions (severability clause)
If a provision of these general terms and conditions is invalid, the rest of the contract remains valid. The relevant statutory provisions apply instead of the invalid provision.
